Synopsis
This subject builds on Principles of Contractual Liability and Principles of Tortious Liability to provide students with an understanding of how the rules of common law and equity, together with the provisions of applicable legislation such as the Trade Practices Act 1974 (Cth), Fair Trading Act 1989 (Qld) and Sale of Goods Act 1896 (Qld), affect contractual and other obligations. The subject covers a range of topics including the implication of terms and effect of vitiating factors under contract law, the statutory prohibition against misleading and deceptive conduct, and the scope of the existing economic torts. While the subject matter is approached primarily from an Australian perspective, consideration is also given to comparative international treatment of the issues raised.
