Synopsis
This subject examines the Commonwealth Constitution, focusing on the scope of Commonwealth constitutional power within the Australian federal system. Topics include the most important Commonwealth legislative powers: the trade and commerce, taxation, corporation, external affairs, appropriation, and conciliation and arbitration powers; sections 90 & 92; the executive and judicial powers of the Commonwealth. Particular emphasis is placed on federal/state relations, the notion of the federal balance, and the High Court of Australia's approach to the interpretation of the Commonwealth Constitution.
