Synopsis
This subject deals with the theory and principles of dispute resolution with particular reference to current trends in Australia compared to several other jurisdictions. It examines theories of conflict and conflict management and considers comparativelythe strengths and shortcomings of litigation, arbitration, mediation, conciliation, mini-trial and neutral evaluation. It also deals with dispute systems design and the implications of conflict management developments for lawyers and the legal system.
